The term “duty of disclosure“ refers to the obligation to inform a third party about the facts of a case. Such obligations often affect companies that are under the supervision of a public authority (e.g. banks or payment institutions). In this case, the obligation is to the responsible authority, which in Germany is usually the BaFin.
